WHEP.EAS, on htay 27, 1903, ":esters Paving Construction Company
filed a Board of Adjustment Case No. MB3-1 as a renewal applica-
tion to continue a temcorar. use of the land for open mining of a
natural mineral in a i•lineral-Cons,;rvatien (M-C) Zone District under
the Jefferson County Zoning Resolution Eor the Life of the Mine;
and
WHEREAS, the applicant previously was granted a special exception
for a temporary use of land for purposes of excavating and
removing quarry agcregat? on 20 acres of land in a
Mineral-Conservation (I~-C) Zone District for a period of five (5)
years from June 21, 197ti, to June 20, 1983, subject to specific
conditions and restrictions in Case No. h178-1; and
WHEREAS, on June 15, 1983, the Annual Report was heard and the
hearing for renewal of a permit was continued to June 22, 1983,
and July 13, 1983, on which dates a Eull and complete hearing was
held by the Board of Adjustment with all parties having a right
to call witnesses, introduce exhibits and cross-examine all wit-
nesses called to testify; and
WHERL•'AS, subject property was properly posted as shown by the
Jefferson County Zoning Department's Affidavit of Posting in the
file and by testimony of the applicant and board members; and
WHEREAS, the Jefferson County Zoning Resolution 25-C-5 was
amended on February 20, 1960, to provide that special exceptions
granted under this section shall extend for the life of the mine
as defined by 34-32-103, C.R.S. 1973, as amended; and
WHEREAS, testimony was heard from the applicant, from Ron Servis,
attorney for the Deer Creek Mesa Protective Association, from
expert witnesses and from other citizens and interested persons;
and
