HALL, pro- <br />perty owners <br />LCC?.':'I~~>i: ^eer CreeF; Q~.:arry - Section 12, <br />Ta,~nship 6 South, Range 70 FJest <br />(a?~rox. 5 mi. west on Deer Creek <br />C=.nyos Road) as more s~:•ecifically <br />described on Exhibit "A" attached <br />hereto ar.d incorporated herein by <br />reference <br />REQUEST: Request for renewal of s_cecial <br />operation zn a 'rlinet'a5-Censer:~~ion <br />(i-~-C) Zone District for the Life <br />cc the Mine Operations <br />WHEP.EAS, on htay 27, 1903, ":esters Paving Construction Company <br />filed a Board of Adjustment Case No. MB3-1 as a renewal applica- <br />tion to continue a temcorar. use of the land for open mining of a <br />natural mineral in a i•lineral-Cons,;rvatien (M-C) Zone District under <br />the Jefferson County Zoning Resolution Eor the Life of the Mine; <br />and <br />WHEREAS, the applicant previously was granted a special exception <br />for a temporary use of land for purposes of excavating and <br />removing quarry agcregat? on 20 acres of land in a <br />Mineral-Conservation (I~-C) Zone District for a period of five (5) <br />years from June 21, 197ti, to June 20, 1983, subject to specific <br />conditions and restrictions in Case No. h178-1; and <br />WHEREAS, on June 15, 1983, the Annual Report was heard and the <br />hearing for renewal of a permit was continued to June 22, 1983, <br />and July 13, 1983, on which dates a Eull and complete hearing was <br />held by the Board of Adjustment with all parties having a right <br />to call witnesses, introduce exhibits and cross-examine all wit- <br />nesses called to testify; and <br />WHERL•'AS, subject property was properly posted as shown by the <br />Jefferson County Zoning Department's Affidavit of Posting in the <br />file and by testimony of the applicant and board members; and <br />WHEREAS, the Jefferson County Zoning Resolution 25-C-5 was <br />amended on February 20, 1960, to provide that special exceptions <br />granted under this section shall extend for the life of the mine <br />as defined by 34-32-103, C.R.S. 1973, as amended; and <br />WHEREAS, testimony was heard from the applicant, from Ron Servis, <br />attorney for the Deer Creek Mesa Protective Association, from <br />expert witnesses and from other citizens and interested persons; <br />and <br />
