COLOWYO CC';;L COMPANY <br /> <br />5]JI STATE HIGHWAY 13 uEEMER COLORADO 91E 61 <br />TELEPHONE 1]O ]I 826~a 631 <br />~eptember 4, 1979 <br />Mr. Walter Heine, Director <br />Office of Surface Mining <br />U.S. Department of the Interior <br />1951 Constitution Avenue, N.W. <br />Washin4ton, D.C. 20240 <br />SUBJECT: Coloonlo Coal Company <br />Request for Experimental Practice Permit <br />Dear Mr. Heine: <br />Pursuant to_Sec. 711 of the Surface Mining Control and Reclamation Act <br />of 1977, Colowyo Coal Company hereby applies for a permit allowing Colowyo to <br />engage in an experimental practice in the constructicn of a spoil fill area <br />• within its permit boundaries. <br />The practice recommended constitutes a variance from the perr:ornance <br />standards set Furth in 30 CFP. 715.15. <br />The alternative method of spoil disposition provides an opportunity to <br />advance the technologies of mining and reclamation beyond the effectiveness of <br />the present application of the cited performance standards and will not be <br />expanded or increased other than is necessary to determine the effectiveness or <br />economic feasibility of the practice. <br />The desicn and construction of the spoil area has been the subject of <br />several studies, ail of :which have determined that the technique employed has <br />achieved environmental protections that are equal to or granter than hose <br />required by the permanent regulations during and after the mining and reclama- <br />tion operations and will not reduce the protection to the public health and <br />• safety offered by the regulations. <br />
