Memo to Tyson Powell 3 September 21, 2006
Blasting Vibration Control Plan File No. M-2004-067
vibrations allowed under the approved permit application, which vibrations are allowed regardless
of vibration frequency.
In summary, there is no technical basis for the MLRB decision to approve the MMRR Quarry permit
application to be overturned by the court as that approval relates to the blasting vibration issues raised by
the objectors. There is no possibility for compliant blasting at the proposed MMRR Quarry to damage
offsite structures, including the Black Hawk -Central City Sanitation District Sewage Treatment Plant.
This determination is based on information developed over the past 44 years of intensive vibration
investigations conducted by the United States Bureau of Mines and the United States Office of Surface
Mining, and others. The objectors to the MMRR Quarry have presented no information to show that the
blasting vibration tolerance criteria applied by the DRMS to the MMRR Quarry is in any way insufficient.
attachment(s)
cc: Tom Schreiner, DBMS (via email and w/o enclosures)
Carl Mount, D12MS (via email and w/o enclosures)
David Berry, DRMS (via email and w/o enclosures)
c:Wocuments and settings~acsMy documents\nmur bist vib mem W ago.doc
