Memo to Tyson Powell 3 September 21, 2006 <br />Blasting Vibration Control Plan File No. M-2004-067 <br />vibrations allowed under the approved permit application, which vibrations are allowed regardless <br />of vibration frequency. <br />In summary, there is no technical basis for the MLRB decision to approve the MMRR Quarry permit <br />application to be overturned by the court as that approval relates to the blasting vibration issues raised by <br />the objectors. There is no possibility for compliant blasting at the proposed MMRR Quarry to damage <br />offsite structures, including the Black Hawk -Central City Sanitation District Sewage Treatment Plant. <br />This determination is based on information developed over the past 44 years of intensive vibration <br />investigations conducted by the United States Bureau of Mines and the United States Office of Surface <br />Mining, and others.
