<br />Page 2 <br />Mr. Robert Lucas <br />January 16, 1990 <br />~~ <br />Regardless of whether or not there is any topsoil, unless a mine site can be <br />reclaimed to a beneficial use, we cannot recommend approval of this application <br />at the January 23-24, 1980, meeting of the ASined Land Reclamation Board. 34-32- <br />116(k) Reclamation shall be required on all the affected land. Reclamation <br />(34-32-103(13)) means the employment during and after a mining operation of pro- <br />cedures reasonably designed to minimize as much as practicable, the disruption <br />from the mining operation and to provide for the rehabilitation of affected <br />land through the rehabilitation of plant cover, s~eil stability, water resources, <br />or other measures appropriate to the subsequent beneficial use of such mined <br />and reclaimed lands. <br />If there are any questions, please feel free to contact me. <br />Sincerely, <br />James E.
