Please <br />commit to ripping any compacted areas, too. <br />(d) On page 9, in the reclamation plan, No. 9 states, <br />"No tailings or waste material should remain at <br />closure." Please indicate what will be done if <br />there is waste material remaining. The Rules <br />require that any material be graded to appropriate <br />slopes and revegetated. <br />(4) A letter by Tomas B. Kroening from DOW was referenced in <br />Exhibit B of the application. This letter was never <br />received by the Division. Please send a copy of this <br />letter to us. <br />(5) In a letter dated May 4, 1995, Don Bogart of the DOW stated <br />that cottonwood trees destroyed in the process of mining <br />should be replaced as part of the reclamation. If the pond <br />is to be used for wildlife habitat, the Division agrees <br />with this recommendation. A copy of this DOW letter is <br />enclosed. <br />The decision date for this application is May 26, 1995. Please <br />have responses to the adequacy questions to the Division by noon on <br />May 25, 1995 so that we may have a chance to review them. Failing <br />this deadline, please request an extension that will allow adequate <br />preparation time for adequacy answers and adequate review time for <br />the Division. <br />
