Exhibit 24 <br />• WILLIAMS FORK STRIP PIT RECLAMATION PLAN <br />BACKGROUND <br />Originally, there were three (3) strip pits associated with the Williams <br />Fork strip mine. These were 1) Williams Fork Strip Pit No. 1, 2) <br />Williams Fork Strip Pit No. 2, and 3) Williams Fork Strip Pit No. 3. <br />Williams Fork Strip Pits No. 1 and No. 3 have been reclaimed. The <br />reclamation plan for Williams Fork Strip Pit No. 2 is the area to be <br />discussed in this Exhibit. All references to Williams Fork Strip Pit in <br />this Exhibit refer to the original Williams Fork Strip Pit No. 2. <br />In the approved Empire Energy permit submitted in 1983, the highwall of <br />the Williams Fork Strip Pit was planned to be used as a second portal <br />access to the No. 9 Mine ("P" Coal Seam). The portal access was to be <br />called the No. 9A Portal area. Subsequently, Empire Energy requested a <br />• delay in contemporaneous reclamation for the Williams Fork Strip Pit <br />area. The original request for delay in contemporaneous reclamation has <br />been included as Attachment 1 to this Exhibit. However, due to economic <br />constraints, the No. 9 Mine was shut down in 1985. Therefore, the 9A <br />portal access is no longer needed. The No. 9 portal area is now <br />undergoing reclamation activities. The decision to abandon the No. 9 <br />Mine was made prior to the installation of any portal related facilities <br />at the Williams Fork Strip Pit. <br />RECLAMATION PLAN <br />The major steps to be incorporated as part of the reclamation plan for <br />the Williams Fork Strip Pit include: <br />• Removal of structures and facilities <br />• Covering of coal seams <br />• Backfilling and grading <br />Redistribution of topsoil <br />-1- <br />
