6.4.13 EXHIBIT M -Other Permits and Licenses <br />20. Attached are review comments from the US Army Corps of Engineers. Please note that a <br />wetland delineation for determination of jurisdictional wetlands will be required. Please provide <br />the status of this requirement. Please address. <br />21. Please provide the status and details of the City of Rifle Watershed Protection Permit as <br />required and as specified in Exhibit M. Please respond. <br />6.4.19 EXHIBIT S -Permanent Man-made Structures <br />22. Exhibit C-Mine Plan Map shows the location of a house within 200 feet (approximately 50') <br />from the Cell B excavation. In accordance with Rule 6.4.19, please provide a notarized <br />agreement between the applicant and the person(s) having an interest in the structure, that the <br />applicantis to provide compensation for any damage to the structure. In the event a notarized <br />damage waiver cannot be obtained, please provide an appropriate engineering evaluation that <br />demonstrates that such structure shall not be damaged by activities occurring at the mining <br />operation. Please respond. <br />Once again, I will look forward to your response on or before May 21, 2006 to allow adequate <br />time for review before the May 25, 2006 decision date. Rule 1.8.1 states that changes and <br />additions to the permit application must be filed with the Division and the County Clerk and <br />Recorder.
