Through
your letter and phone call, I understand that you are not requesting to wash mined
product at this time, although it may be requested in the future. As we have discussed,
the applicant for this DMG permit must either purchase water acceptable for this use that
will be hauled to the site or he must change the use of water rights that he owns in water
court prior to using any water for washing mined product. Your client must base his
operating plans and business decisions on the assumption that the mined product will be
sold and hauled away unwashed, until such time as a water supply to wash mined
product is permitted.
This office understands that you are not requesting to use water for washing product at
this time, and therefore, will not request denial of a mining permit through the Division of
Mining and Geology for this reason.
Sincerely
~J~^'
Don West
Water Resources Engineer
cc: Harry H.
