Exhibit A <br />m Attached m end made a pert of that certain Agrcement to Minc Within 200 Feet of a Men•Made <br />Smcture made between Asphalt Paving Company, end Kerr-McGee Gath<ring LLC <br />General Guidelines for Design and Construction Activities On or Near <br />Kerr-McGee Gathering LLC and Kerr -McGee Rocky Mountain Corporation <br />Pipelines and Related Facilities <br />This list of design, construction ono centractor requirements, including but not limited to the following, is for the design and <br />installation of foreign utilities or improvements on Kerr McGee GaUering LLC (KMG) ri9htaf-way (ROW). These are rid <br />intended fo, nor do they waive or madily any rights KMG may have under existing easements or ROW agreements. For <br />information regarding KMG's rights end requirements as they pertain to the existing easements, please reference existing <br />easements and amendments documents. This list of requirements is applicable for KMG fedlities on easements antl in roatl <br />rights of ways only. Encroachments on fee property should be referted to the Land 8 ROW Department. Any reference to KMG <br />in the below requirements is meant to indude and apply to any Kert McGee entity. <br />Design <br />• KMG shall be provided suffident prior notica of planned activities involving excavation, blasting, or any type of consVUdion <br />on KMG's ROW or near its fedlities. This is to determine and resolve any location, grade ar encroachment prohlems and <br />allow for the protection of KMG's facilities and the generel public. This prior notification is to be made before the actual <br />work is to take place. <br />• The envoaching entity shall provide KMG with a set of drawings for review and a sal of final censtmdion drawings <br />showing all aspects of the proposed facilities in the vicinity of KMG's ROW. The envoaching entity shall also provide a set <br />of'as-built drawings' and submit to KMG, showing the fedlities in the vidnity of KMG's ROW upon completion of the work. <br />• Only fedlities shown on tlrewings reviewetl by KMG will be approved for installation on KMG's ROW. All drawing revisions <br />that effect fedlities proposed to be placetl an KMG's ROW must be epprovetl by KMG in writing. <br />• KMG shall approve the design of a!I permanenf road crossings. <br />• Any repair to surface facilities following future pipeline maintenance or repair work 6y KMG on It's'Drior tights' ROW will be <br />at the expanse of the developer or landowner. In addikan, any repair to surface fadliges following future Pipeline <br />maintenance or repair work by KMG on replacement ROW grentetl to relocate KMG fadlges will also be tlone at the <br />expense of the developer or landowner unless errpressly addressed in surface use agreements and eDProved U writing by <br />KMG. <br />• The depth of cover over the KMG pipelines shall not De increased or reducad nor suKeca modified far drainage wkhout <br />KMG's written approval. <br />• ConsWction of any permanent sVUdure within KMG pipeline easement is not permitted without written approval by KMG. <br />• Planting of shrubs antl Vass is not permitted on KMG pipeline easement without written approval by KMG. <br />• Irrigation equipment i.e. badcflow prevent devices, meters, valves, valve bozos, etc. shall not be located on KMG easement <br />without written approval by KMG. <br />• Foreign utility installations, IE, tliskibution gas, oil and Bas gathering, water, electrie, telephone, cable and sewer lines, etc., <br />may uoss perpendialar to KMG's pipeline wimin the ROW, provided that a minimum of eighteen Inches (18~ of vertical <br />dearance is maintainetl 6etwean KMG pipeline(s) and the foreign uGliry. Any installation by a foreign utility wim less than <br />18' of vertical separation is not allowed without written eDProvel by KMG. In no case will vaRical separation be leas than <br />12' whether written ar cwt. Constant line elevations must be maintained across KMG's entire ROW width, gravity drain lines <br />are the only exception and must be epProved in writing. Foreign line crossings below the KMG pipeline must be evaluated <br />. by KMG to ensure that a significant lengm of the KMG line is not exposed and unsupported during cencWdion. Foreign <br />line crossings above the KMG pipeline with less than 18' of dearence must be evaluated by KMG to ensure that addttlonel <br />support is not necessary to prevent settling on lop of the KMG nature) gas pipeline. A KMG representative must be on eke <br />during any crossing activities to verify dearence depths and to assure the integrity and support of the KMG fadlity. All <br />installations of foreign crossings done by boring and or jacking require me KMG facility to be exposed to verity ctearencas. <br />• Foreign utilities shall not run paallel to KMG pipelines within the KMG easement wimout written permission by KMG. A <br />minimum of 10.0 feel of horizontal separation must ba maintained in parallel installations whether the foreign utility is <br />placed within the KMG easertrent or adjacent to the KMG easement. Any deviatlon from Ne f0.0' horizontal requirement <br />must be approved in canting by KMG end en'as built survey provided to KMG sear installation. <br />• The foreign utility should be atlwsed that KMG maintains caNodic protection on its pipelines and fadliges. The foreign <br />utility must coordinate their naNOdic proteLtion system with KMG's. At the request of KMG, foreign uliliges shall install far <br />allow to be Installed) cathodic protection test leads at all vossings for lha purposes of monitoring cathodic protection <br />interference. The KMG~CP technidan end the foreign utility CP tachnidan shall perform post construcion CP interterenca <br />testing. Interference issues shall be resolved by mutual agreement between foreign utility and KMG. All coals asaodated <br />with the cortedion of camotlic protection intederenca issues on KMG pipelines as a result of the foreign utility crossing <br />shall be borne by the foreign utility for a period of one year from tlate the foreign utility is put in service. <br />• The developer shall understand that KMG whether spedfically required per federal law, or by tympany standard, will mark <br />the routing of It's underground fedlities with aboveground pipeline markers and teat leads and maintain those markers and <br />test leads. Markers will be installetl at every point the pipeline route Uanges direction and adequate markers will be <br />installed on straight sections a(pipeline to insure, in the sole opinion of KMG, the safety of the public, contractor, KMG <br />personnel and KMG facilities. <br />• On all foreign utility vossings and / or encroachments, metallic foreign lines shall be coated with a suitable pipe coating (or <br />a distance of et least 10 feet on either side of the crossing. <br />Page 1 of 3 Revision 3/0112004 <br />
