Aug-30-06 01:36P <br />• <br />August 30, 2006 <br />Lorencito Coal Company <br />c/o Ron Thompson <br />peak Project Management, LLC <br />34115 County Road 20.8 <br />Trinidad, CO 81082 <br />Dear Mr. Thompson: <br />The Hill Ranch will be excavating a site in Lorencito Canyon this fall. Ultimately this <br />will be a site for a permanent pond to service our ranching and land management plan. <br />As a result of this work, there will be a substantial surplus of topsoil. <br />I would prefer that the Lorencito Canyon Mine use this soil material to help make up any <br />topsoil shortage that the mine encounters in completing final reclamation. This will help <br />to minimize further mine related disturbance at topsoil borrow area BA-3 located in <br />upper Jeff Canyon also located on Ranch property. <br />i The coal loadout is being reclaimed to Industrial Use to support the long term <br />• management plan for the Hill Ranch. I understand that mine reclamation regulations <br />require that the mine revegetate the site to control erosion. The Ranch would prefer that <br />the mine use the minimum amount of topsoil necessary to achieve final reclamation and <br />bond release. This location will be used as a staging area for personnel and equipment <br />and excess soil will make it difficult to achieve this use.
