i•
October 14, 2005
Lorencito Coal Company
do Ron Thompson
Peak Project Management, LLC
34115 County Road 20.8
Trinidad, CO 81082
Re: Lorencito Mining Pernrit No. CO-96-084
Post Mining Land Use Change
Dear Mr. Gorham:
I have reviewed the proposed change to an Industrial Use Post-Mining Land Use
classification for the following areas:
1. Mine Office Location
2. Train Load-out
• 3. The Haul Road located outside of the area disturbed by coal extraction.
I am supportive of this change as it will more adequately serve the needs of the industrial
use activities planned for these areas and other adjacent properties as long as the
following terms and conditions are met prior to release of reclamation liability:
1. The change to an Industrial Use classification does not transfer any reclamation
responsibility or liability to the land owner.
2. The loadoutsite is returned to a level or uniform Bade with positive drainage to
the pond located on the northeast corner of the property.
3. The land owner is not responsible for removal of the soil storage pile located
south of and adjacent to the loadout
4. Berms along the sides of the haul roads are removed.
Si/ncerely, r ~D
U~~~ T
Bobby Hill
Land Owner
