i <br />16.Please be aware that an NPDES permit for this site must be in place prior to discharge of <br />water from the pit or facilities. A well permit for the pit area must also be approved prior to <br />exposing groundwater. Please submit proof that these permits have been secured by GJP, <br />as soon as possible. <br />17.The presence of an Eagle's nest, on the island adjacent to the proposed site, was mentioned <br />during the pre-operational inspection. This issue is directly addressed in the application or <br />any correspondence from the Colorado Division of Wildlife ICDOW). If this is an active <br />Eagle's nest, please provide confirmation from the CDOW, that the proposed operation is not <br />expected to adversely affect any nesting activities of the Eagle's. <br />18.Please provide information on the presence and estimated population of Threatened and <br />Endangered wildlife species in the vicinity of the site, that are on federal or state lists. <br />19.Please provide a weed control plan that will be implemented throughout the life of the <br />operation. <br />20.When information for several required exhibits is contained in a report, included in one <br />section of the application, please be sure to reference where that report can be found. The <br />report location should be referenced in each applicable exhibit. <br />21.Please provide quantitative estimates of cover and height for each vegetative association to <br />be affected by the operation. <br />22.The lease agreement for this site gives GJP the right to install telephone, power, and water <br />lines to the site. It also indicates that these utilities will be removed at reclamation. If any <br />utilities or structures are to be installed for this operation, the installation and reclamation <br />details must be included in the mining and reclamation plans as well as the reclamation cost <br />estimate. If not addressed in this application process, future installation of these facilities <br />will require a revision to the permit. <br />23.The lease agreement specifies that GJP has one year, from the time the pit is mined out or <br />the lease is terminated, to complete reclamation of the site. It is highly unlikely that <br />reclamation, capable of satisfying the requirements of the Mined Land Reclamation Act and <br />the Construction Materials Rules and Regulations, can be completed in one year. GJP must <br />be aware that the terms of the lease will not absolve GJP of the requirement to fully reclaim <br />the site, per the requirements of the reclamation plan. The landowner may succeed to the <br />permit at that time, and assume responsibility for the remaining reclamation. Otherwise, GJP <br />may be required to obtain another right of entry, at that time, to complete reclamation. <br />24.The application must show all existing structures, including fences, roads, buildings, ditches, <br />etc. and specify the owner of each. The application must also specify which of these <br />structures will be permanently removed, removed and replaced, relocated (with proposed <br />new location), or left unaffected. <br />25.The engineering demonstration submitted in Exhibit S adequately demonstrates that an <br />excavation setback of 30 feet is satisfactory to protect structures from being adversely <br />affected by the proposed mining operation. However, GJP did not commit to adhering to a <br />30 foot excavation setback. Please provide this commitment. <br />
