Everist's l l2 Permit Application for Maryland Creek Ranch,
Permit No. M-96-049
Dear Ms. Katmil[ar:
The Summit County Depar[ment of Commuttiry Development, Lower Blue Planning Commission aztd Board of
County Commissioners have reviewed L.G. Evetis['s application for a Regular Operation (112) reclamation permit
for the proposed Maryland Creak Ranch gravel and sand mining operation and have the following comments:
post Minine Land Uu: The application indicates [hat "rangeland' will be the pos[ rttining land use. The application
also stasis that within the 2l6 acre permit boundary approximately 106 acres ate intended [o become water suttace,
5 acres will be roads and g acres will be devoud [o ranch headquarters and associated buildings, leaving only 97
u:res as rangeland. These figures however, do not reflect the fact that there ere currently 23.4 acres of existing
jurisdictional wetlands within the petmi[ boundary. Additionally, the applican[ is proposing to create 4.g acres of
wetlands, including fencing and buffering [o keep cattle out of these areas, u mitigazioo for their proposed fill of
approximately 3.3. acres of wetlands in the processing area. It would appear that the amount of land within the
permit boundary which could possibly be used e9 rangeland is only about one third the total land area.
The Colorado Division of Wildlifa has reviewed this applicaion and indicated the[ ar many as 41 animal species
(some of which are identified in Exhibi[ H of the application) have been found ro use the habitat type found within
[he proposed Maryland Creek Ranch permi[ boundary. Of the 41 species identified 14 are considered to be special
status species, including Federal migratory, candidate and endangered species, State threatened species oriel U.S.
Forest Service sensitive ;tad tnanage[nen[ indicator species.
It would seem [hat rangeland is neither the mos[ appropria[e nor the predominant post tniniog land use within the
petmi[ boundary. The County believes [ha[ it would be more appropriaze for [he Division of Minerals and Geology
[o review [his application with consideration of the post mining land use being "wildlife habitat".
Section 306 of the Clean Water Act: Section 306 requires source performance standards and monitoring
requirements. The proposed Maryland Crt.ek mining plan states that the proposed mining operation will comply
with all applicable faders! aced state water quality laws and regulations. However, there is no information on
standards and monitoring.
u:~w~ urrr¢as~orc
SUMMIT COUNTY GOVERNMENT • POST OFFICE BOX 68 • BRECKENRIDGE, COLORAbO 80424
(970)453-2561•(970)453-5461 FAX
