~. <br />~ NOW THEELEFORE, Pursuant to the authority set forth in the Colorado <br />Open Mining Land Reclamation Act, the Land Reclamation Board of the State of <br />Colorado has determined that the following land stabilization and reclama- <br />lion procedures will be followed in the mining operation of Adams in Sections <br />14, 23 and 24, Township 1 South, Range 67 West, Adams County, Colorado and <br />Adams hereby agrees to faithfully perform the Land stabilization and reclama- <br />lion work required herein. <br />1. Adams will monitor and control fugitive dust to keep same in <br />compliance with the dust emission standards set by the Colorado <br />Air Pollution Control Commission. <br />2. Blasting will be conducted during daylight hours only, and in a <br />manner to alleviate or curtail shock and concussion nuisance by <br />controlling the size of the blast. <br />3. Daily operations will not begin before 6:00 a.m. nor extend past <br />10:00 p.m. <br />4. Plan and agreement will be updated annually so that new techniques <br />can be utilized as they are produced or found. <br />5. Adams will furnish the Land Reclamation Board a performance bond <br />in the amounC of Eighty Five Thousand Five Hundred Dollars ($85,500.00) <br />to insure that the work required herein will be accomplished. <br />6. Wherever possible Adams will stockpile and retain topsoil on <br />the property covered by this permit for future use on said property. <br />7. Unless development plans are scheduled for a particular area within <br />a period of three (3) years after cessation of mining operations, <br />Adams will grade and stabilize any surface area disturbed by this <br />operation and revegetate the area, following the best information <br />available from qualified organizations or persons. <br />8. Adams will maintain and stabilize finished slopes to a ratio <br />no steeper than two (2) horizontal to one (1) vertical. (The <br />above can revert to a less steeper slope to conform to Local <br />zoning regulations). <br /> <br />
