<br />d. Topsoil and overburden stockpile locations are located on <br />the revised mining map. A copy ^f the map has been <br />furnished to the landowner. <br />e. Noted. <br />f. The ponds will remain in <br />approved reclamation plan <br />agreed upon 6y the landowner <br />accordance with the currently <br />unless a change is mutually <br />and the operator. <br />g. The operator has not channelixed the river. None of the <br />mining operations will cause increased depth and rate of <br />flow of the river, erosion or disturbance ^f irrigation <br />diversion structures. The river course was not changed by <br />the mining operator. Riprapping has been provided in a <br />minimal amount and only to protect the river back from <br />serious erosion. The current lease holds the landowner <br />harmless from damage caused by the operator. <br />h. All areas are included in the reclamation plan and the plan <br />map. <br />i. The operator concurs in reclamation of any area disturbed <br />by the mining operation. <br />j. The operator concurs to grade the area to allow drainage <br />generally in the downstream direction. <br />k. The operator will coordinate with the landowner prior to <br />the siting and construction of new roads. Roads <br />constructed for the mining operation will be reclaimed in <br />the same manner as other areas of disturbance. <br />1. The mining timetable is contained in the first page of the <br />mining plan. Areas will be mined in the order of 1, 2, 4, <br />and 3 unless a different order is agreed to by the operator <br />and landowner. <br />m. The "cresent points" on the eastern portion will be Ieft as <br />is. The one near the center of the area, will 6e graded <br />out to conform to the final topography. This was discussed <br />by the landowner and operator on a site visit. $oth <br />parties agreed. <br />12. a. The operator intends to approach the landowner to discuss <br />different or changes in water useage and rights which may <br />vary from past useage. The operator has been using this <br />water for the past ten years with the knowledge of the <br />landowner. <br />b. There are no retention ponds within the permit area. <br />c.
