<br />8. <br />DMG Response: The permit application reflects a distinction between overburden piles <br />and topsoil piles. Overburden excavated from one azea of the pit will be used to reclaim <br />an area previously mined. Minor amounts of clean fill material generated from off-site <br />construction projects will be used to backfill the excavated mine pit. The overburden <br />generated from off site must meet the requirements of Rule 3.1.5(9). Topsoil piles are <br />stored in three separate locations and will be replaced on the affected area to a depth of <br />12" to 18." <br />Is the vegetation information complete and accurate (Rule 6.4.10)? <br />(Anderson, 9/21/98), (10) <br />"The statement is not clear on whether willows, narrowleaf cottonwoods, and other <br />wetland species will be planted on reseeded sites. " (Diane & Thane Anderson- <br />September 21, 1998) <br />DMG Response: The applicant provided a seedmix for the wetland areas which <br />consist of the following; Reed Canarygrass (5#PLS/acre), Tall Fescue <br />(5#PLS/acre), Redtop (5#PLS/acre) .and Strawberry Clover (5#PLS/acre). <br />Willows, Narrowleaf Cottonwoods and other wetland species will be planted <br />along the perimeter of the two proposed wetland sites at a density of one plant <br />every one-hundred feet. <br />9. Has the applicant identiTed the other permits, licenses and approvals which <br />he presently possess or will be seeking and which are necessary to conduct <br />the proposed mining operation (Rule 6.4.13)? <br />(Anderson, 9/21/98), (8) <br />DMG Response: The applicant has identified all other permits, licenses and <br />approval which will be possessed prior to mining. <br />10. Has the applicant provided complete and accurate demonstration of his <br />source of legal right to enter (Rule 6.4.14)? <br />(Anderson, 9/21/98), (7) & (I5) <br />"There is no documentation submitted with this application as required by the Rules and <br />Regulation providing proof of ownership of surface or mineral rights. The deed <br />presented in this packet is irrelevant to the ownership rights. In addition, the relevant <br />deed on record does not grant mineral ownership rights to the applicant. " (Diane & <br />Thane Anderson- September 21. 1998) <br />DMG Response: The applicant provided proof of ownership of the surface and <br />mineral rights for the proposed mining location. DMG must accept a good faith <br />showing of legal right to enter and mine the materials and cannot determine <br />property rights. <br />
