noC within the scope and authority of the Construction Materials Act. However, the concern of
incompatibility of mining wish other planned land uses remains and will be presented by the
objectors to the Board for consideration at the scheduled hearing.
III. ISSUES RAISED BY THE OBJECTORS -AFTER INFORMAL CONFERENCE:
11. Groundwater Contamination (received from Pinnacle Pines LLC on Apri13, 2000)
"Groundwater studies conducted by Pinnacle's consultants have determined that a plume of
materials (DIINP, methylene chloride, chlorinated volatile organic compounds, pesticides, and
non-chlorinated hydrocarbons) crosses Pinnacle's property at depth and crosses below the
affected lands specified in the application. The depth of mining contemplated in the application
may well intersect the plume. The application discusses that mining will release groundwater ...
and this release of groundwater, if the plume is intersected, may in fact pose a significant health
risk through the interaction of groundwater with humans, or through the airborne release of
chemicals once the groundwater meets the air when it is routed across Old Brighton Road
(Exhibit G). Lafarge has not disclosed the results of groundwater studies of the land affected by
the application. Nothing that Pinnacle has seen in the application discusses this issue, treats the
subject of the plume, or discounts its potential risk to public health. If Lafazge has relevant
information in this regard, it should be required to submit such information"
Response -See response to Item 2 above.
12. Slope Stability (received from Pinnacle Pines LLC on April 3, 2000)
"The application discloses that the mining face will be "neazly vertical" and that upon
reclamation, the face will still have a 3: l slope. Pinnacle believes that the steepness of the
reclaimed faces, descending into a water storage facility, may well pose a safety risk from
landslides and slope failures to people who will become residents of the adjoining housing
development planned by Pinnacle. Lafarge should provide additional geotechnical information
regarding this instability prior to any approval of the application."
Response -See response for Items 3 & 7 above.
13. Additional Information Needed (received from Pinnacle Pines on Apri13, 2000)
"Pinnacle believes [he application does not adequately address th~ requirements of Rule 6.4
