The proposed mining application could have significant impacts <br />on adjacent properties and a responsible applicant should make a concerted effort to work with <br />their neighbors." <br />Response -meaningful outreach is outside the scope and authority of the Construction Materials <br />Act. Adjacent land owners were notified according to applicable Construction Material Rules <br />and Regulations. Adjacent land owners have submitted several letters to DMG and to the <br />applicant with comments and concerns regarding this proposed project. Through this response <br />and other measures, the applicant has attempted to address the specific concerns of each land <br />owner as well as the Division. <br />9. Transportation System-Hazard <br />"The Tanabe Pit borders both Brighton Road on the west side, and East 112th Avenue on the <br />North side, i[ is important for the regional transportation system that adequate right-of-way's for <br />these roadways be preserved. The haul routes used in this operation will bring an abundance of <br />heavy trucks to either the intersection of Brighton Road and East ]04th Avenue, or to East 112th <br />Avenue and US Highway 85. Neither of these intersections are ideal for this type of traffic and <br />will present a safety hazard to the general traveling public. The haul operations of these heavy <br />trucks will also cause extraordinary damage to the roadway system used to transport the <br />materials." <br />Response -Consideration of possible impacts to and preservation and maintenance of the <br />regional transportation system is outside the scope and authority of the Construction Materials <br />Act. Dazen Sterling with the Commerce City Department of Public Works dropped this concern <br />during the June 13, 2000 pre-Hearing Conference. <br />10. Designated Land Use <br />"Rocky Mountain Mutual Housing is intending to build affordable single-family and multi- <br />family housing adjacent to the Tanabe property. We consider that the proposed gravel operation <br />is incompatible with our planned housing cornmunity. We aze concerned about health and safety <br />issues associated with gravel mining." "Commerce City's Comprehensive Plan has designated <br />the area between Eas[ 104th and East l 12th Avenues and Brighton Boulevard and US 85 for <br />future residential and retail uses. We believe that allowing a gravel operation within [his area is a <br />mistake and incompatible with residential uses. This property does not appear to be in an area <br />that contains significant minerals deposits, as defined by the State. Additionally, it is not within <br />the Mineral Conservation Overlay Zone District, as defined by Adams County." <br />Response -Land use planning and the compatibility of mining with other land uses as well as the <br />validity of significant minerals deposits within the proposed affected land aze concerns that aze <br />
