ISSUES RAISED BY THE OBJECTORS -INITIAL PUBLIC COiVIMENT PERIOD: <br />1. Surface Irrigation <br />"The application does not specifically address surface irrigation facilities. How and by what <br />methods will surface irrigation occur?" <br />Response -The applicant will not be irrigating the property during the mining operation. Surface <br />irrigation to establish vegetation during reclamation activities may use an above grade sprinkler <br />system. The applicant now owns all surface irrigation facilities located within the proposed <br />affected land. <br />2. Groundwater Contamination <br />"The application suggests gravel cuts up to 25 feet deep ... This will likely expose ground water <br />with potential contaminants. Has the applicant tested the ground water for contamination? What <br />are the results of ground water tests? Can all ground water test results be made available to <br />adjacent property owners before any decisions are made by the Division of Minerals & <br />Geology?" <br />Response - On May 24, 2000 the applicant provided a detailed hydrologic assessment, including <br />a characterization of the aquifer of concern and copies of available water quality monitoring data, <br />of possible impacts to surface and groundwater of the affected land and surrounding area during <br />mining and reclamation. The Division concurs with the assessment which concludes that no <br />contaminants of concem at concentrations equal to or greater than state standards will be exposed <br />during mining and reclamation, and that dewatering flows routed offsite will not contain <br />contaminants of concem at or above state water quality standards. In addition, the applicant has <br />also incorporated the following commitments into the mining and reclamation plan: <br />As part of the pit dewatering system, the applicant will install adouble-lined containment <br />system from the edge of the affected land to the point of discharge. In the event of a failure of <br />the containment system that causes a leak of the dewatering flow outside the proposed site <br />boundary, the applicant will notify the Division within 24 hours of the leak detection. <br />Prior to any discharge of dewatering flows from the proposed Tanabe site, the applicant will <br />provide a letter to the Division from the Colorado Department of Public Health and Environment <br />(CDPHE), Water Quality Control Division, stating that the app]icant has approval to discharge <br />offsite. <br />
