Effluent Limitations (continued) d) Burden of Proof Requirement The permittee has the burden o! proo! when requesting relic! from total suspended solids (TSS), total iron and/oz settleable solids limitatioaa. Relief shall be greeted only when necessary and shall not be greeted when the permittae has control over the discharge. The permittea should endeavor to meet the primary limitations whenever possible. 1) For rainfall. to waive TSS and total iron limitations, it i. necessary to prove that discharge occurred within 48 hours after measurable precipitation hoe stopped. In addition, to waive - settleable aolida limitations, it ie necessary to prove that discharge occurred within 48 hours after precipitation greater than the 10-year, 24-hour event hoe stopped. 2) For enowmelt. to waive TSS and total iron limitations, it is necessary to prove that discharge occurred within 48 hours after pond inflow hoe stopped. In addition, to waive settleable solids limitations, it is necessary to prove that discharge occurred • within 48 hours after pond inflow volume greater than the 10-year, 24-hour event has stopped. The Division shall determine the adequacy of proof. As part~of this determination, the Division shall evaluate whether the permittee could have controlled the discharge in such a manner that primary liuoitatione could have been met. All manual dewatering must meet TSS and total iron limitations. 2. Stormwater Hanaaement Plan (SW10?1 A Stormwater Management Plan (SWl0?) shall be developed for the portion of each facility covered by this section of the permit. The SWMP shall be prepared in accordance with good engineering practices. (The plan need not be completed by a registered engineer.) The plan shall identify potential sources of pollution (including sediment) which may reasonably be expected to affect the quality of etormwater discharges associated with the mining operation. In addition, the plan shall describe and ensure the implementation of beat management practices (BMPS) which will be used to reduce the pollutants in etormwater discharges associated with mining activity. Mining operations must implement the provisions of the SNU@ required wader this part as a condition of this permit.
