Effluent Limitations (continued) <br />d) Burden of Proof Requirement <br />The permittee has the burden o! proo! when requesting relic! from <br />total suspended solids (TSS), total iron and/oz settleable solids <br />limitatioaa. Relief shall be greeted only when necessary and shall <br />not be greeted when the permittae has control over the discharge. <br />The permittea should endeavor to meet the primary limitations <br />whenever possible. <br />1) For rainfall. to waive TSS and total iron limitations, it i. <br />necessary to prove that discharge occurred within 48 hours after <br />measurable precipitation hoe stopped. In addition, to waive - <br />settleable aolida limitations, it ie necessary to prove that <br />discharge occurred within 48 hours after precipitation greater <br />than the 10-year, 24-hour event hoe stopped. <br />2) For enowmelt. to waive TSS and total iron limitations, it is <br />necessary to prove that discharge occurred within 48 hours after <br />pond inflow hoe stopped. In addition, to waive settleable solids <br />limitations, it is necessary to prove that discharge occurred <br />• within 48 hours after pond inflow volume greater than the 10-year, <br />24-hour event has stopped. <br />The Division shall determine the adequacy of proof. As part~of this <br />determination, the Division shall evaluate whether the permittee <br />could have controlled the discharge in such a manner that primary <br />liuoitatione could have been met. All manual dewatering must meet TSS <br />and total iron limitations. <br />2. Stormwater Hanaaement Plan (SW10?1 <br />A Stormwater Management Plan (SWl0?) shall be developed for the portion <br />of each facility covered by this section of the permit. The SWMP shall <br />be prepared in accordance with good engineering practices. (The plan <br />need not be completed by a registered engineer.) <br />The plan shall identify potential sources of pollution (including <br />sediment) which may reasonably be expected to affect the quality of <br />etormwater discharges associated with the mining operation. In <br />addition, the plan shall describe and ensure the implementation of beat <br />management practices (BMPS) which will be used to reduce the pollutants <br />in etormwater discharges associated with mining activity. <br />Mining operations must implement the provisions of the SNU@ required <br />wader this part as a condition of this permit. The Division reserves <br />• the right to request and review the plans, and to require additional <br />measures to prevent and control pollution, as needed. <br />Amended LO/I3/94 Effective 1_tJlt/oi, <br />
