The Pemrittee, Washington County, desires to conduct a mining operation known as Shook <br />Gravel Pit 1, for the purpose of e#racting Gravel. The Pemuttee will not mine any secondary commodities at <br />this site. <br />B. On May 24, 2001 the Mined Land Reclamation Board (the "Board's approved the Pemrittee's <br />application for this permit and directed that this permit be issued upon the filing with the Division of Minerals and <br />Geology (the "Division") of performance warranty approved by the Division. On May 24, 2001 the Board made the followurg fmdmgs: <br />1. The operation will nd adversely affect the stability of any significant, valuable, and <br />pemlanem man-made structure located within two hundred feet of the Affected Land, except where there is an <br />agreement between the Operator and the persons havurg an irrteres[ in the structure that damage to the structure is <br />to be compensated for by the Pemrittee; and; <br />
