<br /> <br />2.05.4(2)(f) DISPOSAL OF DEBRIS, ACID FORMING AND TOXIC MATERIAL <br />Upon final reclamation, coal waste material will be taken offsite <br />to the nearby P&M Edna Mine for disposal in an approved location. <br />There is simply no place to permanently store the material at the <br />Apex site. All metal scrap will be recycled and other debris will <br />be disposed of in the nearby approved landfill. <br />2.05.4(2)(8) SEALING OR MANAGING MINE OPENINGS, EXPLORATION <br />HOLES, OTHER BOREHOLES OR WELLS <br />Mine Portal Seals <br />Portals at the site consist of three drift portals approximately 20 <br />feet wide and 5.5 feet high on the bench area and one fan portal <br />approximately 10 feet wide and S.5 feet high. As is shown cn the <br />map "Regional Geology and Cross-Section", it is seen that the <br />portals are at the absolute highest point of all the workings. For <br />this reason, the portals will be reclaimed by providing a distance <br />of 25 feet of non-combustible fill to the entries, as described in <br />MSHA regulation 3C CFR 75.171?-2 which states: <br />"Slope or drift openings reouired to be sealed under 75.1711 <br />shall be sealed with solid, substantial, incombustible <br />material, such as concrete blocks, bricks or tile, or shall be <br />completely filled with incombustible material for a distance <br />of at least 25 feet into such openings." <br />CMLRD Rule 4.07.3 states that drift portals can be backfilled and <br />must be consistent with CFR 75.1711. Water inflow into the mine was <br />never a problem and there is no chance that there will ever be a <br />water buildup against the portals. Also, access by people, <br />livestock, fish and wildlife and machinery will be prevented. <br />According to Rule 4.C7.3, this seal is satisfactory in this case. <br />Once these portals are reclaimed to this specification, a <br />notification will be submitted to MSHA and a copy will be sent to <br />the Division. <br /> <br />~~9/92 <br />~~~,2 ~~ <br />SAP <br />
