2.05.4(2)(f) DISPOSAL OF DEBRIS, ACID FORMING AND TOXIC MATERIAL
Upon final reclamation, coal waste material will be taken offsite
to the nearby P&M Edna Mine for disposal in an approved location.
There is simply no place to permanently store the material at the
Apex site. All metal scrap will be recycled and other debris will
be disposed of in the nearby approved landfill.
2.05.4(2)(8) SEALING OR MANAGING MINE OPENINGS, EXPLORATION
HOLES, OTHER BOREHOLES OR WELLS
Mine Portal Seals
Portals at the site consist of three drift portals approximately 20
feet wide and 5.5 feet high on the bench area and one fan portal
approximately 10 feet wide and S.5 feet high. As is shown cn the
map "Regional Geology and Cross-Section", it is seen that the
portals are at the absolute highest point of all the workings. For
this reason, the portals will be reclaimed by providing a distance
of 25 feet of non-combustible fill to the entries, as described in
MSHA regulation 3C CFR 75.171?-2 which states:
"Slope or drift openings reouired to be sealed under 75.1711
shall be sealed with solid, substantial, incombustible
material, such as concrete blocks, bricks or tile, or shall be
completely filled with incombustible material for a distance
of at least 25 feet into such openings."
CMLRD Rule 4.07.3 states that drift portals can be backfilled and
must be consistent with CFR 75.1711. Water inflow into the mine was
never a problem and there is no chance that there will ever be a
water buildup against the portals. Also, access by people,
livestock, fish and wildlife and machinery will be prevented.
According to Rule 4.C7.3, this seal is satisfactory in this case.
Once these portals are reclaimed to this specification, a
notification will be submitted to MSHA and a copy will be sent to
the Division.

~~9/92
~~~,2 ~~
SAP
