The mining plan states that "if the soil stockpiles remain undisturbed for more than one <br />growing season a cover crop of western wheatgrass will be planted at a rate of 3.0 lbs / <br />200 sq. ft " The Division recommends that the operator use the accepted Natural <br />Resources Conservation Services seed mixture on the topsoil stockpiles, instead. <br />Rule 6.3.4 Exhibit D- Reclamation Plan <br />8. According to the mining plan maps approximately five topsoil stockpiles aze proposed. <br />Please the dimensions of these topsoil piles and calculate anticipated amount of cubic <br />yazds of topsoil on-site at all times. <br />Rule 6.3.5 Exhibit E- Man <br />9. The Site Description submitted in Exhibit B describes an ephemeral drainage running <br />along the southern edge of the site. Please depict the location of this drainage on the <br />mining plan and reclamation plan maps provided in Exhibit E. <br />10. Please provide a map labeling the names of the owners of record of the surface of the <br />affected area and of the land within two hundred (200) feet of the affected azea per Rule <br />6.3.5(2)(b). <br />11. All maps provided in the application package display both red and black solid lines. <br />Please explain what the red rectangle and black circle represent. <br />12. Please illustrate a permanent locatable point (e.g. a county road intersection) in relation to <br />the proposed mining operation on a map. <br />13. The Division has enclosed a copy of the official map of the adjacent Logan County <br />Operation (M-1978-249), Kokes Gravel Pit. Please clearly illustrate the location of the <br />proposed MMM Partnership Gravel Pit in relation to the Kokes Gravel Pit on the same <br />map to demonstrate that the permit boundaries of these two operations do not overlap. <br />As stated in the Office of the State Engineer's (OSE) response letter (enclosed) to the Division, <br />"exposure of ground water must not occur during or after mining operations. If water will be <br />used for any purpose at this site, the applicant will need to document that the water was obtained <br />from a legal source, or the water was diverted in priority under a water right decreed for such <br />industrial use." Additionally, OSE states that "if stonnwater runoff is intercepted by this <br />operation and is not diverted or captured in priority, it must be released to the stream system <br />within 72 hours. This may require a discharge permit from CDPHE-WQCD. Otherwise, the <br />operator will need to make replacements for evaporation." Please contact the State Engineer's <br />Office with any questions about the aforementioned conditions. <br />Please be advised that MMM Partnership's New 110 Application may be deemed inadequate, <br />and the application may be denied on June 22, 2006, unless the enclosed adequacy review items <br />are addressed to the satisfaction of the Division. If you feel more time is needed to complete your <br />reply, the Division can grant an extension to the decision date.
