After the expiration of the first five years of the lease term and payment by Lessee to Lessor of the royalty required by paragraph 7E above, the Lessee shall be priv:_leged to terminate this Lease Agreement by written notice to ttie Lessor and thereafter this Lease Agreement shall be void and of no further force or effect except the obligations imposecl upon the Lessee for reclamation of the property as set forth above. 13. In the event that all or any part of the leased premises are encumbered by any lien at the time of execution hereof, the Lessor shall obtain a written subordination cf any such lien or encumbrance to the rights of the Lessee hereunder, and upon failing so to do the Lessee may declare this lease • void at its option. If this Lease Agreement is declared void pursuant to this paragraph, any advance royalty paid to the Lessor shall be repaid to the Lessee upon demand therefor. 14. Prompt payment of the amounts herein agreed upon to be paid by Lessee and compliance with all terms and conditions herein expressed is of the essence of this Agreement, and if Lessee shall fail to make said payment or payments or shall fail to keep and perform the covenants herein contained, Lessor may give Lessee written notice of his intention to cancel this contract thirty days after such notice is given to the Lessee unless within said thirty-day period the default complain~:d of shall have been cured, and if not cured at the end of sai3 • thirty-day period, this Agreement shall become null and v~~id, and Lessee shall forthwith remove all of its property and vacate the premises, and any advance royalty paid to Lesser shall be retained by Lessor as his sole and separate property. 15.
