Any sums paid to the Lessor as advance 8'~~O <br />• royalty shall be a credit against the first ,.. <br />royalties which become due and payable after <br />the payment of such advance royalty. <br />B. Lessee shall conduct its business on the leased <br />premises in accordance with each and every requirement of the <br />Colorado Land Reclamation Board, including, but not by wa.y of <br />limitation, all obligations for reclamation of the property <br />whether imposed by condition contained within the permit, statute <br />or regulation, and Lessee shall mine the sand and gravel to the <br />full depth of the deposit whether or not such obligation is <br />imposed by the permit, statute or regulation. <br />9. During the term of this Lease Agreement, tYie Lessor <br />shall have the right and privilege to extract pit run material <br />for his own use without the necessity of payment therefor. Lessor <br />• agrees that in the extracting of such pit run material he: shall <br /> remove such material to the full depth of the deposit and that <br />Lessee shall not be obliged to pay any royalty to the Le:asor in <br />regard to such material so extracted. <br />10. Lessor warrants the title to the leased premises <br />and to the right of way granted to the Lessee pursuant hereto. <br />11. Lessee covenants that when it has finished its <br />mining operations in any area it will release that area too the <br />Lessor. Lessee shall be the sole judge of when it has ":_inished" <br />with an area, and if any survey is necessary to effect s~ich <br />release then such survey shall be provided at the expense of the <br />Lessor. In connection with any such release, Lessor und~:rstands <br />• that the Lessee must preserve the integrity and the security of <br />the area in which it conducts its operations on the leased premises, <br />and the Lessee shall be privileged to impose conditions ~~n any <br />such release which shall preserve such integrity and security. <br />The concern of the Lessee in this regard is that unlimited <br />access cannot be permitted in, to or through the leased premises, <br />and, in particular, to the area in which the Lessee is then <br />-4- <br />
