In fact, Mr. Zgainer indicated that there are no <br />• threatened or endangered wildlife species within the permit or <br />adjacent areas. <br />(4) Reclamation <br />Because the area is utilized as wildlife habitat, Mr. Zgainer <br />expressed his preference that the area be reclaimed with <br />compatible grasses and forbes for wildlife use following <br />mining activities. Peerless Resources, Inc. had no problem <br />with his desires and, in fact, will move to reclaim the site <br />with grasses and forbes compatible to wildlife. <br />(5) Water Quality <br />Mr. Zgainer is concerned about water quality in the permit and <br />adjacent areas. This concern was alleviated when Mr. Zgainer <br />was informed that Peerless Resources, Inc. would construct a <br />sedimentation pond and obtain an NPDES discharge permit. All <br />• water draining from the affected area of the surface <br />facilities would be routed by diversion ditches into the <br />sedimentation pond before discharge into Coal Gulch. <br />(6) Miscellaneous <br />Mr. Mike Zgainer was given the opportunity, at any time, to <br />contact Peerless Resources, Inc. with any concerns or <br />problems. Conversely, Mr. Zgainer invited Peerless Resources, <br />Inc. to come visit him at any time if there were any problems <br />with the hunters using the access road above the planned <br />surface facilities area. <br />Unfortunately, the documentation regarding the July 30, 1984 meeting has <br />been inadvertently misplaced. However, the items discussed at this <br />meeting are listed above. Furthermore, it is the understanding of <br />Peerless Resources, Inc. that the Division has provided the Colorado <br />Division of Wildlife a copy of the permit and requested comments from <br />• them. <br />-38- <br />
