Mike Zgainer or the Colorado Division of Wildlife was
• concerned about the future status of this road since he
believed the Colorado Division of Wildlife has a right-of-way
access along it. Mr. Alan Czarnowsky, representing Peerless
Resources, Inc. indicated that the light use road above the
surface facilities area would not be removed and that Peerless
Resources, Inc. would work to maintain a ditch along the road.
Also, Peerless Resources, Inc. would not deny any access to
the Colorado Division of Wildlife or hunters that will utilize
the State lands northwest of the Peerless Resources, Inc.
surface facilities area.
Peerless Resources, Inc. did express its concerns regarding
hunting or shooting rifles too close to the surface facilities
area. This action could pose a safety concern to workers at
the mine. Mr. Zgainer assured Peerless Resources, Inc. that
any problems with regard to hunter safety should be
immediately brought to his attention, and he would move to
resolve any problems of this nature. However, Mr. Zgainer
could not anticipate any hunter safety problems, especially in
regard to the Peerless Resources, Inc. surface facilities.
(2) Critical Winter Range
Certain areas northwest of the surface facility area is
utilized as critical winter range by both deer and eik. Mr.
Zgainer and Mr. Czarnowsky discussed the availability of
critical winter range and decided that the planned mining
activities would not create any impact on these areas.
Rather, active mining operations and surface facilities of
underground operations tend to create more habitat through the
generation of minor amounts of dust that help keep snow melted
around the mining operation.
(3) Threatened and Endangered Wildlife Species
. Mr. Mike Zgainer said that the Peerless Resources, Inc.
operation would not affect any threatened or endangered
