Mike Zgainer or the Colorado Division of Wildlife was <br />• concerned about the future status of this road since he <br />believed the Colorado Division of Wildlife has a right-of-way <br />access along it. Mr. Alan Czarnowsky, representing Peerless <br />Resources, Inc. indicated that the light use road above the <br />surface facilities area would not be removed and that Peerless <br />Resources, Inc. would work to maintain a ditch along the road. <br />Also, Peerless Resources, Inc. would not deny any access to <br />the Colorado Division of Wildlife or hunters that will utilize <br />the State lands northwest of the Peerless Resources, Inc. <br />surface facilities area. <br />Peerless Resources, Inc. did express its concerns regarding <br />hunting or shooting rifles too close to the surface facilities <br />area. This action could pose a safety concern to workers at <br />the mine. Mr. Zgainer assured Peerless Resources, Inc. that <br />any problems with regard to hunter safety should be <br />immediately brought to his attention, and he would move to <br />resolve any problems of this nature. However, Mr. Zgainer <br />could not anticipate any hunter safety problems, especially in <br />regard to the Peerless Resources, Inc. surface facilities. <br />(2) Critical Winter Range <br />Certain areas northwest of the surface facility area is <br />utilized as critical winter range by both deer and eik. Mr. <br />Zgainer and Mr. Czarnowsky discussed the availability of <br />critical winter range and decided that the planned mining <br />activities would not create any impact on these areas. <br />Rather, active mining operations and surface facilities of <br />underground operations tend to create more habitat through the <br />generation of minor amounts of dust that help keep snow melted <br />around the mining operation. <br />(3) Threatened and Endangered Wildlife Species <br />. Mr. Mike Zgainer said that the Peerless Resources, Inc. <br />operation would not affect any threatened or endangered <br />-37- <br />
