Proof of notice is provided for all adjacent land owners and CDOT. No utilities <br />aze located within 200 feet of the boundary. Colorado State Highway 9 is within <br />200 feet of the boundary. Proof of notice and damage compensation agreement is <br />provided. <br />2. The maps are signed according to The Rule. <br />3. Adjacent surface owners include Pazk County, Bruce Plankington and Fairplay <br />Fishing Limited Liability. Mr. Bruce Plankington is the owner of record west of <br />Highway 9. <br />4. Utilities, creeks, buildings, oil and gas wells and lines aze not located within 200 <br />feet of the boundazies ofthe property. Colorado State Highway 9 is identified on <br />Exhibit C. <br />5. Man-made structures within 200 feet of the boundary include a perimeter fence <br />and gate owned by the applicantloperator and Colorado State Highway 9. The <br />map has been modified to include the perimeter fence. <br />6. Topsoil stockpiles will be place adjacent to and inside the perimeter fence and <br />phase boundary of each phase in order to serve as storm water diversion structures <br />as well as visual and noise barriers. The anticipated height of the stockpiles will <br />be approximately 3 feet. Perimeter stockpiles will be placed similazly with each <br />section in order to effectively manage storm water and maximize visual and noise <br />mitigation. Anticipated stockpile locations for Phase One aze located on Exhibit <br />C as requested. <br />7. A Notice of Intent to Construct Monitoring Holes was submitted to the State <br />Engineer's Office on April 10, 2006. The applicant intends to drill sufficient <br />holes approximately 20 feet deep to determine depth to groundwater. The <br />applicant, a licensed well driller, anticipates groundwater at 16 to 18 feet below <br />the ground surface. Mining will occur to 10 feet or within two feet of <br />groundwater, whichever is shallower.
