The majority of items were adequately addressed, however, <br />there are a few remaining items which will need some additional follow-up. Per your <br />request, the office has extended the decision date until May 23, 2006. This should be <br />adequate time to address the few remaining items as outlined below. <br />There aze three remaining issues that will require additional submittals, responses or time <br />to fully address. <br />1. The first is the pending Deazing Road agreement with the county in order to <br />comply with exhibit S. Per recent conversations, it appears that this <br />agreement is forthcoming. In the event it is not, the permit application <br />approval will be conditioned to require submittal of this agreement prior to <br />affecting any land within 200 feet of the road. If this occurs, a map must be <br />submitted cleazly indicating that no land will be affected within 200 feet of <br />this road until such agreement is reached. <br />2: The"second item is final submittal and approval of a permanent seed mix and a <br />temporary seed mix. The species and their respective percentages of the <br />overall mix that was submitted via e-mail by the NRCS aze acceptable to the <br />Division. The numbers of pure live seed will still need to be added and <br />formally submitted. Their recommendation with respect to the temporary <br />seed mix (using an annual to provide cover until permanent vegetation is <br />established) is also a good recommendation and should be included with the <br />response. Also, their temporary mix is acceptable to the Division. <br />3. The additional information provided with respect to the volumes of mined <br />materials and the breakdown into various components should be adequate to <br />complete a financial warranty calculation.
