Dear Mr. Waldron:
On behalf of our client, Oglebay Norton Industrial Sands, Inc., this letter responds to the
Division's adequacy review comments in your letter of May 18, 2006. Our responses
are listed in the same order as in your letter (included as an attachment for reference
purposes).
1. Dearing Road Structure Agreement: Attached please find an executed structure
agreement with EI Paso County, allowing disturbance within 200 feet of Dearing Road.
2. Seed Mixes: Attached are the revised seed mix tables, including the addition of a
cereal grain to the temporary seed mix in Table E-2.
3. Financial Warranty: We understand the financial warranty amount is forthcoming
from the Division.
We understand that the decision date for this application is Tuesday, May 23, 2006. If
additional time is needed for the Division to review and approve this application,
however, we request that the decision date be extended to Friday, May 26, 2006.
