• f~ks and Gesso, LLC <br />CDPHE -Water Quality Control Division <br />A CPDES permit, authorizing the discharge of water to the Fulton Ditch, for mine <br />dewatering purposes only, is being sought by the Applicant and will be finalized <br />before discharges are initiated. <br />CDPHE -Air Pollution Control Division <br />Prior to ground-surface disturbing activities at the 124~h Estates Sand and Gravel <br />Mine, the operator will obtain a Fugitive Dust Permit from the CDPHE for those <br />activities. This permit will be kept active during the life of the mine. <br />Air permits will also be obtained for each piece of mobile equipment to be used at <br />the site, as may be required by the Air Pollution Control Division. <br />U.S. Armv Corps of Engineers <br />Potential wetland areas within the proposed mining site are considered isolated <br />wetlands, not within the regulatory jurisdiction of the Army Corps of Engineers, as <br />defined by the U.S. Supreme Court in Solid Waste Agency of Northern Cook <br />Countv v. U.S. Armv Coros of Engineers, No. 99-1178 (January 9, 2001). A <br />letter of concurrence from the Denver Regulatory Office of the Corps of <br />Engineers is presented in Appendix B. <br />Local Land Use Authority <br />The property, subject of this Regular 112 Permit application, is being annexed by <br />the City of Brighton, and will be placed within an industrial zone district of the <br />City, where water reservoirs are a Use by Right.
