Any such machinery, <br />equipment or improvements not removed prior to the expira- <br />tion of said period of ninety (90) days following,termina- <br />tion of said Lease shall be deemed affixed to the leased <br />premises and shall become and remain the property of the <br />Lessor. <br />11. Lessor retains the right to farm, graze, <br />irrigate and othercaise use on a non-interference basis any <br />portion of the premises not occupied by Lessee's operation <br />and wi.il not intentionally interfere with Lessee's activ.it.ies <br />in any way. Lessee shall have the sole right to determine <br />the location of its operation and the orderly progression of <br />its operations; provided, however, the present hay£ieJd <br />consisting of. approximately fourteen (14) acres shall not be <br />mined during the first or second phases of the mini.ny opera- <br />tion as those phases are outlined in the t~tined Land Reclama- <br />tion Permit. Lessee s)iall relocate and/or erect fences to <br />keep livestock out of the pit operation area, aild if, in the <br />opinion of Lessee, locked gates are necessary on any access <br />to operational areas, such gates shall be installed and <br />maintained by Lessee with keys provided to Lessor. <br />].2.
