PART I <br />Page No. 8 <br />Permit No. CO-0036595 <br />• ` A. DEFINITION OF EFFLUENT LIMITATIONS <br />~) 3. Burden of Proof Requirements <br />The permittee has the burden of proof when seeking relief from total suspended solids (TSS), total iron and/or settleable <br />solids (SS) limitations. Outfall 004 is eligible for relief, providing the ezceedence is caused by precipitation. <br />Relief may be granted for each discharge occurrence only when necessary and shall not be granted when the permi[[ce <br />has control over the discharge. The permittce should endeavor to mcet the primary limitations whenever possible. The <br />permittce will need [o show that ezceedence of the applicable limitations was caused by precipitation and no other sources <br />and that the discharge was beyond their control. All manual dewatering of the ponds shall meet TSS and total iron <br />limitations. <br />a) For rainfall, to waive TSS and total iron limitations, it is necessary to prove that discharge occurred within 48 hour <br />after measurable precipitation has stopped. In addition, to waive settleable solids limitations, it is necessary to provj <br />that discharge occurred within 48 hours after precipitation greater than the 10-year, 24-hour event has stopped. <br />b) For snowmelt, to waive TSS and total iron limitations, it is necessary to prove that discharge occurred within 48 <br />hours after pond inflow has stopped. In addition, to waive settleable solids limitations, it is necessary to prove that <br />discharge occurred within 48 hours after pond inflow volume greater than the 10-year, 24-hour event has stopped. <br />Should a precipitation event or snowmelt occur, the permittce shall submit adequate proof in order for an exemption to <br />be claimed. Said proof shall be submitted as an attachment to the Dischazge Monitoring Report (DMR) for the <br />appropriate period. The Division shall determine the adequacy of proof. As part of this determination, the Division <br />shall evaluate whether the permittce could have controlled the discharge in such a manner that primary limitations could <br />have been met. <br />•~ 4. Post-Minine Areas <br />Commencing at the time active mining has ceased and surface azeas have been returned to the required contour all <br />applicable discharges may be eligible for limitations other than those specified in Part I.A.1. These post-mining <br />limitations shall remain in effect until bond release. The permittce shall notify the Division upon cessation of active <br />[Wining so that consideration of appropriate permit modificatioY[s can be made. <br />B. MONI'T'ORING REQUIREMENTS <br />1. >'Yeauencv and Samole Tvce <br />In order to obtain an indication of the probable compliance or noncompliance with the effluent limitations specified in <br />Part I.A.1, the permittce shall monitor all effluent pazazneters at the following frequencies. Such monitoring will begin <br />immediately and last for the life of the permit unless otherwise noted.
