PART I Page No. 8 Permit No. CO-0036595 • ` A. DEFINITION OF EFFLUENT LIMITATIONS ~) 3. Burden of Proof Requirements The permittee has the burden of proof when seeking relief from total suspended solids (TSS), total iron and/or settleable solids (SS) limitations. Outfall 004 is eligible for relief, providing the ezceedence is caused by precipitation. Relief may be granted for each discharge occurrence only when necessary and shall not be granted when the permi[[ce has control over the discharge. The permittce should endeavor to mcet the primary limitations whenever possible. The permittce will need [o show that ezceedence of the applicable limitations was caused by precipitation and no other sources and that the discharge was beyond their control. All manual dewatering of the ponds shall meet TSS and total iron limitations. a) For rainfall, to waive TSS and total iron limitations, it is necessary to prove that discharge occurred within 48 hour after measurable precipitation has stopped. In addition, to waive settleable solids limitations, it is necessary to provj that discharge occurred within 48 hours after precipitation greater than the 10-year, 24-hour event has stopped. b) For snowmelt, to waive TSS and total iron limitations, it is necessary to prove that discharge occurred within 48 hours after pond inflow has stopped. In addition, to waive settleable solids limitations, it is necessary to prove that discharge occurred within 48 hours after pond inflow volume greater than the 10-year, 24-hour event has stopped. Should a precipitation event or snowmelt occur, the permittce shall submit adequate proof in order for an exemption to be claimed. Said proof shall be submitted as an attachment to the Dischazge Monitoring Report (DMR) for the appropriate period. The Division shall determine the adequacy of proof. As part of this determination, the Division shall evaluate whether the permittce could have controlled the discharge in such a manner that primary limitations could have been met. •~ 4. Post-Minine Areas Commencing at the time active mining has ceased and surface azeas have been returned to the required contour all applicable discharges may be eligible for limitations other than those specified in Part I.A.1. These post-mining limitations shall remain in effect until bond release. The permittce shall notify the Division upon cessation of active [Wining so that consideration of appropriate permit modificatioY[s can be made. B. MONI'T'ORING REQUIREMENTS 1. >'Yeauencv and Samole Tvce In order to obtain an indication of the probable compliance or noncompliance with the effluent limitations specified in Part I.A.1, the permittce shall monitor all effluent pazazneters at the following frequencies. Such monitoring will begin immediately and last for the life of the permit unless otherwise noted. The results of such monitoring shall be reported on the Discharge Monitoring Report form (See Pan I.E.).
