This should be <br />a resse in t e permit app ication. <br />• RESPONSE: <br />The overburden and interburden samples were obtained along the exposed <br />highwall created by previous Arness-McGriffin mining activities. These <br />samples were obtained by grab sample techniques; that is, samples were <br />chipped away from above the "A" Coal Seam and below the "A" Coal Seam. <br />Samples were composited and placed in "Ziploc" bags; they were <br />immediately shipped to Bookcliffs Commercial Laboratories in Steamboat <br />Springs for analyses. The samples were collected by Alan Czarnowsky of <br />ACZ Inc. during the summer of 1984. <br />9. Section 4.05.8 of the permit application states that there are no <br />potential acid-forming or toxic-forming overburden present. This <br />is not correct, see comment 7 under Section 2.04.6 above, this <br />section should be revised when addressing the above referenced <br />comment. <br />• RESPONSE: <br />As mentioned earlier, Peerless Resources, Inc. and the Division have <br />agreed that there are no acid-forming or toxic-forming overburden or <br />underburden material surrounding the "A" Coal Seam present.
