Banks and Gesso, LLC <br />Exhibit M -Other Permits and Licenses <br />County Land Use Permit <br />A Pueblo County Special Use Permit application for mineral extraction and processing <br />has been submitted and will be obtained prior to commencing operations. <br />County Flood Hazard Area Development Permit <br />An application for a Flood Hazard Area Development Permit has been submitted to <br />Pueblo County concurrently with the Special Use Application <br />CDPS State Discharge Permit/Stormwater Permit <br />Prior to any ground-disturbing activities at the proposed permit area, a <br />CDPS/Stormwater Permit will be obtained from the Colorado Department of Public <br />Health and Environment (CDPHE) that will account for any and all off-site discharge and <br />will contain a plan for control of that discharge. <br />Air Permits <br />Prior to any ground-surface disturbing activities (topsoil removal and stockpiling, access <br />road development, haul road construction or material hauling) or processing activities <br />(crushing, screening), the Applicant will obtain Construction Permits from the CDPHE. <br />These permits will be kept active during the entire life of the mine. <br />Road Access and Maintenance Agreements <br />The applicant is working with Pueblo County Public Works and the Colorado Department <br />of Transportation (CDOT) to finalize road improvement and maintenance agreements for <br />Nyberg Road and access to State Highway 50. <br />Substitute Water Supply Plan/Gravel Pit Well Permit <br />A Substitute Water Supply Plan approval and Gravel Pit Well Permit will be obtained <br />from the State Engineer's Office prior to exposing groundwater. <br />St. Barbara Sand and Gravel Mine 03028 <br />Trans Colorado Concrete z8 February 19, 2004 <br />
