The Division is required to make an approval or <br />denial decision no later than May 15, 1995 therefore, your response <br />should be submitted to the Division as soon as possible. If you feel <br />more time is needed to complete your reply, an extension to the <br />decision date can be granted by the Division upon receipt of a written <br />waiver of your right to a decision by May 15, 1995 and request for <br />additional time. <br />1. The application states that a barbed wire fence is within 200' of <br />the affected area. Colorado Highway No. 9 may also be within <br />200'. If not owned by the operator, please submit a waiver from <br />the owner of these structures which allows you to mine within 200 <br />feet. Alternatively, you can submit verification of an agreement <br />with the owner that any damage caused by the operation will be <br />compensated for by the operator. A third option is to demonstrate <br />the operation will not adversely affect the stability of these <br />structures. <br />2. During our inspection of 4-20-95, we measured approximately 6" of <br />gravelly sandy loam in one hole dug along the southwestern edge of <br />the permit area. This material will be sufficient for reclamation <br />purposes. Please state your commitment to salvage and replace a <br />minimum of 6" of topsoil, or all available growth medium, during <br />reclamation. <br />3. Briefly describe how the pit run is mined, e.g. removed with a <br />/ loader, screened, placed in haul trucks, etc. <br />
