RE: Adequacy Review And New Decision Date
Ansley Pit No. 2, File No. M-95-027
Dear Mr. Peters:
Listed below are adequacy review comments on the Ansley Pit No. 2
permit application. The Division is required to make an approval or
denial decision no later than May 15, 1995 therefore, your response
should be submitted to the Division as soon as possible. If you feel
more time is needed to complete your reply, an extension to the
decision date can be granted by the Division upon receipt of a written
waiver of your right to a decision by May 15, 1995 and request for
additional time.
1. The application states that a barbed wire fence is within 200' of
the affected area. Colorado Highway No. 9 may also be within
200'. If not owned by the operator, please submit a waiver from
the owner of these structures which allows you to mine within 200
feet. Alternatively, you can submit verification of an agreement
with the owner that any damage caused by the operation will be
compensated for by the operator. A third option is to demonstrate
the operation will not adversely affect the stability of these
structures.
2. During our inspection of 4-20-95, we measured approximately 6" of
gravelly sandy loam in one hole dug along the southwestern edge of
the permit area. This material will be sufficient for reclamation
purposes. Please state your commitment to salvage and replace a
minimum of 6" of topsoil, or all available growth medium, during
reclamation.
3. Briefly describe how the pit run is mined, e.g. removed with a
/ loader, screened, placed in haul trucks, etc.
