<br /> <br />Response to Adequacy Review No. 2 <br />124'" Estates Sand and Gravel Mine, File Number M-2001-085 <br />The applicant states that any discharge into the Fulton Ditch will be in accordance with the <br />Crossings Agreement executed between the Fulton Ditch Company and Dacoa, Inc.. <br />Please be aware that all agreements need to be established between the applicant, which <br />is Adams County RV Park, LLC, dba 124`" Estates Partners. Dacoa, Inc. is neither the <br />applicant nor the permittee, therefore the Division cannot accept any agreements unless <br />they are execute by Adams County RV Park, LLC, dba 124'" Estates Partners. <br />The applicant and the Fulton Ditch Company will execute an addendum to the Crossings <br />Agreement in which both parties recognize the 124'" Estates Partners as a party to the <br />Agreement with the same rights as granted to Dacoa, Inc. by the contract. <br />The applicant revised the seed mixture to include Western Wheatgrass, Sideoats Grama, <br />Needle and Thread, Streambank VVhea!grass and Slender Wheatgrass. The applicant acknowledges that shallow wells along 124"' Avenue and the water ski club <br />pond will likely be impacted by dewatering of the mine site. The applicant proposes a <br />mitigation plan to address the impacts to the wells and the pond. Please clarify the <br />following regarding the mitigation plan: <br />The applicant implies the dewatering into the Fulton Citch will recharge the groundwater <br />down gradient of the mine. However, the applicant also states that the Fulton Ditch has <br />likely sealed itself by the settling o(fine solids, which create a lining for the ditch. Please <br />clarify if the Fulton Ditch is lined to allow a recharge to the groundwater system, or lined <br />to prevent seepage through the ditch. <br />No implication that the Fulton Ditch will noticeably recharge groundwater has been <br />intended; and the applicant has no expectation that seepage from the ditch will <br />significantly compensate groundwater in the immediate area of the mine for losses <br />attributable to dewatering activity within the mine. Through many years of use, the ditch <br />has likely sealed itself to some extent through the settling of fine solids. <br />
