<br />Daryl and Jovice Billings. Mr. Billings has also raised concerns that obstruction of groundwater flow <br />following the placement of a clay liner in the mining depression may occur. Records of the State <br />Engineer show that Mr. Billings does have a permitted well close to the northern boundary of the area <br />proposed for mining; however, State Engineer's records show that this well was proposed for a depth of <br />180 feet into the Arapahoe Aquifer. Mr. Billings' objection memo of September 4, 2001 also expresses a <br />concern for possible contamination of deep aquifers, as a result of mining activity. His memo appears to <br />express an overall concern for a well, located to the north of the area to be permitted but within a deep <br />aquifer. <br />In response to the concerns of Mr. Billings', the applicant has learned that, in the mid 1990s, a <br />contaminant (DIMP) from the Arsenal was detected in shallow, unconsolidated groundwater, at <br />concentrations below drinking water standards, in the area of the proposed mining location. Due to <br />remedial efforts at the Arsenal, the distribution of this contaminant is now receding. <br />Proposed mining will only remove residual sand and gravel from the historic mine site, until bedrock is <br />reached. 2 to 4 feet of claystone bedrock will then be ripped from the floor of the mine to create a clay <br />liner. Bedrock in this area is very, very thick, and it is extremely improbable that the removal of 2 to 4 feet <br />of bedrock would allow connection to a deeper consolidated aquifer. At 180 feet, Mr. Billings' well is likely <br />into the fringe of the Arapahoe Aquifer. Other deep wells in this area go several hundred feet deep into <br />the Laramie Fox Hills Aquifer. Besides the unliklihood that deep consolidated aquifers could be <br />connected to shallow groundwater by mining activity, wells in those deep aquifers would also not be <br />impacted by the clay-lined reservoir, which will sit on top of the bedrock. <br />The applicant understands that there are some shallow, unpermitted wells along 124'" Avenue used for <br />non-domestic purposes, and as described in the first response to Adequacy Review, will pay the water <br />bills of any such shallow well user showing decreased capacity attributable to mining activity, as these <br />shallow well users are also connected to the South Adams County Water and Sanitation District. The <br />applicant will also escrow $10,000 for the purpose of rejuvenating any of these wells which are physically <br />damaged by mining activity. <br />Although not stated in his memo of September 4, Mr. Billings has also raised a concern regarding <br />increased truck traffic and the effect of such traffic on his rental property, located along 124'" Avenue, <br />immediately north of the proposed mine. This concern was raised at a neighborhood meeting on October <br />3, 2001. Although CDOT has issued State Highway Access Permit No. 601141 to cover the use of the <br />historical access to the site during mining, the applicant has also attempted to offer reasonable <br />compensation to Mr. Billings, if his rental income is affected by mining. These efforts have been met only <br />with counter offers, more opportunistic in nature than reflective of a sincere negotiating position. <br />If you have questions, please call me or Les Ewegen at 303-667-1666.
