2.06.5 PERMITS INCORPORATING VARIANCES FROM APPROXIMATE ORIGINAL CONTOUR <br />RESTORATION REQUIREMENTS FOR STEEP SLOPE MINING <br />Given the discussion in the previous section indicating the absence of <br />steep slopes in the Southfield mine area, EFCI will not seek a variance <br />from approximate original contour restoration requirements due to steep <br />slope mining conditions. <br />EFCI will backfill and regrade mine disturbance areas to a configuration <br />which provides for effective drainage, insures long-term stability, is <br />consistent with premining slopes and landforms, and blends with <br />surrounding undisturbed and reclaimed areas. Consequently, EFCI does not <br />plan to seek a variance from the AOC requirements. <br />Since no steep slopes, as identified by the regulatory definition, exist <br />within the area to be disturbed by the Southfield mining operations and <br />• no variance from AOC requirements will be sought in conjunction with steep <br />slope conditions, the specific requirements of this section are not <br />applicable. <br />2.06.6 PRIME FARMLANDS <br />As described in Section 2.04.12, Prime Farmland Investigations, none of <br />the lands within the Southfield permit area are prime farmland as defined <br />under Section 1.04 (95) of the Colorado Regulations. Dorchester, the <br />previous operator of the Southfield Mine, requested a negative <br />determination from the LMLRD relative to identification of any prime <br />farmlands within the Southfield permit area. This request, dated <br />September 10, 1980, and supporting documentation is provided in Exhibit <br />13, Prime Farmland Investigations. The CMLRD granted Dorchester's request <br />in it's June 27, 1984, Proposed Decision and Findings of Compliance <br />Document for Approval of Mining and Reclamation Permit No. C-037-81. This <br />document is included as Exhibit 14, Proposed Decision and Findings of <br />• Compliance, and the CMLRD's negative determination can be found on page <br />29 of that document. Accordingly, the specific requirements of this <br />section are not applicable. <br />2.06-3 <br />
