<br />MILLIKEN SITE -COMMITMENTS <br />(Permit No. M-2000-087) <br />(September 28, 2000) <br />Total Permitted Acreage :205.2 acres <br />Maximum Allowable Disturbance : 65 acres <br />Total Reclamation Cost : $622,000 <br />Applicant/Operator :Aggregate Industries, Inc. (AII) <br />1. AII will submit a limited financial warranty of $1,000 within 12 months in order for the permit <br />to be issued. AII will submit a properly executed financial warranty of the amount required <br />($622,000) at least 60 days prior to disturbance. The Division should be prepared to <br />recalculate a current reclamation cost if several or more years lapse from permit issuance <br />to start of mining. <br />2. AII will work w/ CDOW to mitigate potential impacts to bald eagles (threatened species) prior <br />to disturbance in [he Phase 1 Area. AII will revise the approved mining & reclamation plan as <br />necessary prior to disturbance in the Phase 1 Area. <br />3. AII will verify and submit to the Division the average width and depths of the slurry wall to be <br />installed prior to mineral extraction. If the slurry wall average depth will be greater than 48' (45' <br />deposit + 3' keyed into bedrock) and/or if the slurry wall average depth will be less than 3.8 feet, <br />the operator will submit a revised reclamation cost and/or stability analysis as deemed necessary <br />by the Division. <br />4. The operator will submit within 60 days of slurry wall completion a final ("as built") <br />construction report summarizing testing results for the tests listed in Table 1 -Materials Quality <br />Control Program of the Technical Specifications for the Milliken Site Slurry Wall Construction. <br />5. AII will maintain 20' of clearance on the non-mined side of the slurry wall around the <br />perimeter. In addition, AII will ensure the toe of the mine slope is a minimum of 117' from the <br />slurry wall. <br />6. AII will mine the site in five (5) cells ranging in size from 6.1 to 40 acres. The largest <br />disturbance expected will occur during excavation of the Phase 3 Area. Pit slopes will be <br />maintained at a 2:1 slope during mining.
