Cattany <br />Division Director <br />Natural Resource Trustee <br />Re; 110 Construction Materials Application for Kit Carson County's Klassen Pit, File M- <br />2006-047, Smith Pit File M-2006-049, and Beeson Pit M-2006-048; Supplementary <br />Adequacy Review <br />Dear, Ms. Brownfield, <br />The Division of Mining, Reclamation and Safety (Division) recently completed apre- <br />operation inspection at the Klassen Pit, File M-2006-047, Smith Pit File M-2006-049, <br />and Beeson Pit M-2006-048. As a result of some observations the Division developed <br />this supplementary adequacy review that lists some additional concerns that were not <br />included in the initial adequacy review. Please note that the decision date for this <br />application is September 15, 2006. All adequacy comments need to be addressed to the <br />prior to the decision date. <br />The primary issue, at all three proposed mine sites, is the presence and extent ofpre- <br />permitmining that has occurred. There was not any reference in the applications to the <br />presence of these un-permitted mines. No reclamation of these un-permited mine sites <br />appears to have occurred. The Division requests additional information on how this will <br />affect the mining and reclamation process. Please see the comments below. <br />6.3.2 Exhibit B- Site Description <br />1. Please provide a description of the extent of mining that has occurred to date on <br />the site, including is aerial extent in relation to the proposed mine boundaries, <br />availability of topsoil from the previously mined area, and the depth that mining <br />has occurred. <br />6.3.3 Exhibit C -Mining Plan <br />1. How does the un-permitted mining disturbance change the mining plan? For <br />example, the mining plan describes disturbing areas of no more then %i an acre at <br />a time, but more then %z an acre is already disturbed.
