<br />July 28, 1986 <br />Mr. Greg Squire <br />Colorado Mined Land Reclamation Division <br />423 Centennial Building <br />1313 Sherman Street <br />Denver, Colorado 80203 <br />RE: Stipulation No. 1, Technical Revision No. 4 <br />"E" Seam - Development Work, Permit C-81-044 <br />Dear Mr. Squire: <br />Empire Energy submits the following information to comply with the above <br />referenced stipulation: <br />• Stipulation No. 1 <br />Prior to any removal of coal as a result of development work in the <br />"E" seam, Empire Energy must receive the approval of the Mined Land <br />Reclamation Division for Empire's plan far monitoring any decreases <br />in the ground water inflow rate into the No. 5 Mine directly above <br />and contiguous to the horizontal area representing the mine area for <br />the No. 6 Mine development work. <br />This inflow shal'1 be measured on a regular basis (to be agreed upon <br />by discussion with Mined Land Reclamation Division Representatives) <br />prior to No. 6 Mine development work and during development work. If <br />it can be demonstrated that no significant inflow exists, this <br />stipulation will be eliminated. <br />Empire Energy requests that this stipulation be eliminated due to the <br />following facts: <br />1.
