Noncompliance (cont'd) <br />b) There were no feasible alternati•aes to [he bypass, such as <br />the use of auxiliary treatment facilities, retention of <br />untreated wastes, or maintenance during normal periods of <br />equipment downtime. This condition is not satisfied if the <br />permittee could have installed adequate backup equipment [o <br />prevent a bypass •.vhich occurred during normal periods of <br />equipment downtime or preventative maintenance; and <br />c) The permittee submitted notices as required in <br />"Notification", paragraph 2-(9) (above). <br />3. Removed Substances <br />Solids, sludges, filter backwash, or other pollutants removed in the course <br />of treatment or control of wastewaters shall be disposed of in a manner such <br />as to prevent any pollutant from such materials from entering waters of the <br />State. <br />4. Facilities Operation <br />The permittee shall at all times .maintain in good Norking order and <br />operate as efficiently as possible all treatment or control facilities <br />or systems installed or used.by the permittee to achieve compliance <br />with the terms and conditions cf this permit. <br />~~ <br /> <br /> <br />1 <br />/1 <br />1 <br />5. Adverse Impact <br />The perrittee shall take all reasonable steps [o minimize any adverse <br />impact tc eaters of the State resulting from noncompliance with any <br />effluent limitations specified in this permit, including such accelerated <br />or additional monitorine as necessary to determine the nature and impact <br />of [he noncomplying discharge. <br />o. Any discharge ,o the waters of the State from a point source ocher than <br />5pecifica'.ly authorized is prohibited. <br />7. Reduction, Loss, or Failure of treatment Facility <br />(a) The ?ermittee shall, to the extent necessary [o maintain compliance with <br />its permit, control production, or all discharges, or both until the <br />facility is restored or an alternative method o.` treatment i5 ?rovide^_. <br />(9) This provision also applies to Dower failures, unless an alternative <br />power source sufficient to c•perate the •Naste•Nater control facilities <br />is oravided. <br />REVISED May 15, 1981 <br />
