~~ <br />_. <br />~_, <br /> <br />I* <br />above. Impountlment will be by means of impoundment dams al- <br />ready constructed and to be constructed, or in the mining pits <br />themselves. Such water will be utilized by applicant in its <br />coal mining operations in the approximate amount of 173.5 <br />acre-feet per year for dust suppression purposes on haul roads <br />and in the mining operation; and 356 acre-feet per year as the <br />permanent pool caoacity of the impoundment dams which will he <br />used for livestock watering and wildlife. In addition, it is <br />estimated that there will be evaporative loss from the water <br />impoundments, based upon local climatic conditions, at such <br />times that surface water is exposed. Based upon the design <br />capacity of such impoundments and limited amounts of water and <br />times when water may be present, such evaporative loss will be <br />less than 163 acre-feet per year. Depletion from the evapora- <br />tion would be 100%; depletion from the dust suppression will <br />approach 100%. Therefore, total annual depletion is estimated <br />to be approximately 692.5 acre-feet. <br />3. The source of replacement water is the conditional <br />water right of applicant known as the Synthetic Products Ditch <br />right, first adjudicated in the District Court for Moffat <br />County in Case No. 1278, September 1, 1960, with priority date <br />of September 17, 1951, and priority number 70. <br />4. The amount consumed by applicant as set forth in para- <br />graph 2 above, from the underground waters resulting from the <br />surface coal mining operations will be substituted by surface <br />waters to which applicant is entitled under the Synthetic Pro- <br />ducts Ditch right by leaving such waters in the Yampa River for <br />senior appropriators. Because of the priority date and amounts <br />of the Synthetic Products Ditch right, no additional storage of <br />that right for purposes of timed releases is considered neces- <br />sary at this time for augmentation purposes. <br />5. Operation and enforcement of plan. Applicant will <br />monitor and record amounts utilized for dust suppression pur- <br />poses and livestock watering which amounts will be available <br />for inspection by the Division Engineer, water Division 6. <br />Additionally, applicant will determine by appropriate means the <br />
