<br />Minutes, May 23-24, 1990 PAGE 20 <br />Mr. Massey requested, on behalf of the operator, that the Board <br />delegate authority to the Staff to continue discussions to reach an <br />agreement. <br />It was MOVED that the Board direct the Division to continue negotiating <br />a compliance schedule with the company, rather than forfeit all or part <br />of the financial warranty. SECONDED AND PASSED UNANIMOUSLY <br />(Kraeger-Rovey, Cooley, O'Connor, Donald and Jouflas). <br />It was MOPED that the Board delegate Mr. Terry O'Connor the authority <br />to review and approve arly schedule negotiated by the Division. <br />SECONDED AND PASSED UNANIMOUSLY (Kraeger-Rovey, Cooley, O'Connor, <br />Donald and Jouflas). <br />It was MOVED that the Board order that the mine be placed under a <br />limited a ernative enforcement and direct the Division to defer future <br />enforcement actions on the outstanding Board Order and outstanding <br />violations, until a resolution agreement is reached. If a resolution <br />agreement is not reached, the Division was directed to present this <br />matter at the June Board Meeting to consider the future actions to be <br />taken regarding these issues. DISCUSSION ITEM <br />u e-ma tng. <br />Rule-making as published in "Colorado Register" on April 10, 1990, for <br />consideration at the May Board Meeting. <br />The Director stated that the process for rule-making begins with the <br />submittal, to the Office of Regulatory Affairs and the Secretary of <br />State, a notice of rule-making and an identification of the Rules that <br />are proposed to be changed. He referenced the packet presented to the <br />Board previously of rules the Division would like the Board to approve. <br />The rules packet contains 2 sets of rules: 1) clean-up rules, i.e., <br />those developed in response to the Regulatory Affairs Office's request <br />that rules duplicative of the Statute be eliminated and 2) conferring <br />rules and how to process permit applications. <br /> <br /> <br />The Director recommended that the Division identify rules that are <br />acceptable for approval and continue discussions of those that will <br />
