Canany <br />Division Director <br />Natural Resource Trustee <br />Listed below are adequacy review comments for the Linke Construction, Inc., Cottonwood Quarry 112(c) Permit <br />Application, File No. M-2004-061. The Division of Minerals and Geology ("Division") is required to make a <br />recommendation no later than December 16, 2004, therefore, yow response to the following adequacy review concerns <br />should be submitted to the Division as soon as possible. <br />As required by Rule 1.6,5 (2), please submit the proof of publication of the public notice caculated in the local <br />newspaper and all owners of record of surface lands, and easement holders that aze on the affected land and within 200 <br />feet of the boundary of the affected land. Proof of notice may be return receipts of a Certified Mailing or by proof of <br />personal service. <br />Rule 6.4.4 Exhibit D- Mining Plan <br />2. The Mining Plan submitted with the application states that a temporary storage/maintenance building will be constructed <br />at the site. The Plan states that the building will be removed when mining is complete, or may remain at the site if the <br />landowner agrees. For purposes of a reclamation bond estimate, the Division will assume [hat the building will be <br />removed during reclamation. Please supply the dimensions of the proposed building so that the cost to remove the <br />building can be calculated <br />3. The Mining Plan states that a road will be built from County Road 55 in the southwest part of the site along the hillside <br />to the level area where mining will start. Please supply the dimensions of this road and include it on the Mining Plan <br />Map. <br />4. The Mining Plan states that if fuel is stored on the site a small containment berm will be placed around the fueling <br />facility to keep anything spilled contained, and that there will be adequate sand to absorb spills and any contaminated <br />material will be disposed of properly. Please also commit to adding a liner below any storage tanks within the berm to <br />protect the material located below the tank and prevent spills from seeping into the ground. <br />Ruie 6.4.5 Exhibit E -Reclamation Plaa <br />5. The proposed future use for the site is rangeland. Please indicate what measures will be taken to protect livestock from <br />falling from the 40-foot highwalls resulting from the mining operation. During the inspection it was stated by the <br />operator that a fence would be installed above the area that was to be mined to isolate the highwalls from the other <br />portion of the rangeland.
