Energy Fuels will not produce any coal processing <br />waste. <br />Section 816.95 Air resources protection. <br />(a) Fugitive dust. Each person who conducts surface mining activities <br />shall elan and employ fugitive dust control measures as an integral part <br />of site preparation, coal mining, and reclamation operations. The <br />• regulatory authority shall approve the control measures appropriate for <br />use in planning, according to applicable Federal and State air quality <br />~ standards, climate, existing air quality in the area affected by mining, <br />and the available control technology. <br />Energy Fuels employs fugitive dust control measures in all phases <br />of the mining and reclamation activities. Control measures currently <br />being utilized are set forth in detail in Section 780.15. These <br />control measures will be used for the remainder of the life of the <br />mine. The operations at Energy Fuels are presently regulated under <br />numerous Emission Permits issued by the Colorado Department of <br />Health, Air Pollution Control Division. Section 778.19 identifies <br />the various permits under which Energy Fuels currently operates. <br />(b) Control measures.
