Section 816.46 Hydrologic balance: Acid-forming and toxic-forming
spoil.
Drainage from acid-forming and toxic-forming spoil into ground and
surface water shall be avcided by--
(a) Identifying, burying, and treating where necessary, spoil, which,
in the judgement of the regulatory authority, may be detrimental to
vegetation or may adversely affect water quality if not treated or
buried;
Acid-forming or toxic-forming materials do not exist within the
overburden to be removed by the proposed mining activities. A
detailed and thorough program of sampling, analyzing and data
compilation o£ overburden has been conducted. Full discussion of
the chemical characteristics of the overburden is presented under
Section 779.14. Results of testing are presented in Table 108,
Results of Analyses on Overburden Samples.
Section 816.49 Hydrologic balance: Permanent and temporary
impoundments.
(a) Permanent impoundments are prohibited unless authorized by the
regulatory authority, upon the basis of the following demonstration:
(1) The quality of the impounded water shall be suitable on a permanent
basis for its intended use, and discharge of water from the impoundment
shall not degrade the quality cf receiving waters to less than the
water-euality standards established pursuant to applicable State and
Federal laws.
(2) The level of water shall be sufficiently stable to support the
intended use.
(3) Adequate safety and access to the impounded water shall be provided
• for proposed water users.
816-50
