Section 816.65 (e) Continued. <br />structure, unless such structure is owned by Energy Fuels and is <br />not leased to any other person. <br />Steps taken by Energy Fuels to minimize the source level, so that <br />safe levels will be maintained include blasting under favorable <br />atmospheric conditions, avoiding the use of unconfined explosives; <br />use of adequate stemming; and designing optimum blast-hole patterns. <br />Energy Fuels will promptly conduct an airblast measurement of any <br />or all blasts at any specified location upon request of the <br />regulatory authority. <br />(f) Except where lesser distances are approved by the regulatory authority, <br />based upon a pre-blasting survey, seismic investigation, or other appro- <br />priate investigation, blasting shall not be conducted within-- <br />• (1) 1,000 feet of any building used as a dwelling, school, church, <br />hospital, or nursing facility; and <br />(2) 500 feet of facilities including, but not limited to, disposal <br />wells, petroleurt~ or gas-storage facilities municipal water-storage <br />facilities, fluid-transmission pipelines, gas or oil-collection lines, <br />or water and sewage lines. <br />Energy Fuels will not conduct blasting within-- <br />1,000 feet of any building used as a dwelling, school, church, <br />hospital, or nursing facility; and 500 feet of facilities including <br />but not limited to, disposal wells, petroleum or gas-storage <br />facilities, municipal water storage facilities, fluid transmission <br />lines, or water and sewage lines as shown in Blasting Pattern <br />Alteration (Coal) (Flap 39) and Blasting Pattern Alteration <br />(Overburden) (1•Sap 40). <br /> <br />S16-80 <br />
