<br />Section 816.54 (c) Continued. <br />(c) In any event, the discharge from underground mines to surface <br />waters will not cause, result in or contribute to a violation of appli- <br />cable water quality standards of effluent limitations; minimizes <br />disturbance to the hydrologic balance, and meets with the approval of <br />the Mine Safety and Health Administration. <br />See 30 CFR 816.55 (a). <br />Section 816.56 Hydrologic balance: Postmining rehabilitation of <br />sedimentation ponds, diversions, impoundments, and <br />treatment facilities. <br />Before abandoning the permit area, the person who conducts the surface <br />mining activities shall renovate all permanent sedimentation ponds, <br />diversions, impoundments, and treatment facilities to meet criteria <br />specified in the detailed design plan for the permanent structures <br />and impoundments. <br />No permanent sedimentation ponds, impoundments or treatment <br />facilities are planned. Permanent diversions will be left in <br />place around excess spoil piles. The ditches will be reno- <br />vated before the permit area is abandoned by repairing any <br />necessary portions, cleaning sediment and debris out, <br />establishing appropriate vegetation and providing soil <br />stabilization. <br />Section 816.57 Hydrologic balance: Stream buffer zones. <br />(a) No land within 100 feet of a perennial stream or a stream with a <br />biological community determined according to Paragraph (c) below shall <br />be disturbed by surface mining activities, except in accordance with <br />Section 816.43-816.44, unless the regulatory authority specifically <br />• 816-66 <br />
